THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.21074 of 2017 ORDER: (Per SK,J) This writ petition was filed assailing the e-auction-sale notice dated 29.05.2017 issued by the Bank of Baroda proposing to put to sale the secured assets belonging to the petitioner on 30.06.2017. By order dated 28.06.2017, this Court permitted the bank to proceed with the auction sale but if a successful bidder was found, the bank was permitted to receive only 25% of the bid amount and was directed to take no further action thereafter till the next hearing.

Today, Sri Srinivas, learned counsel for the respondent bank, would inform this Court that the auction sale held on 30.06.2017 did not materialise for want of bidders.

That being so, challenge to the impugned e-auction-sale notice dated 29.05.2017 is rendered purely academic and does not warrant consideration on merits.

On this short ground, the writ petition is dismissed leaving all issues open. The petitioner is at liberty to invoke appropriate remedies in accordance with law if and when a fresh cause of action arises.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
