THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.7269 of 2019 ORDER:
This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioner/accused seeking to modify the order dated 16.10.2019 passed in Crl.M.P.No.218 of 2019 in Crl.A.No.785 of 2019 by the learned V Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B.Nagar.

Heard learned counsel for the petitioner/accused and learned Additional Public Prosecutor for the 1st respondent-State and perused the record.

By the order impugned, the Court below, while suspending the sentence of imprisonment imposed by the trial Court vide judgment dated 18.09.2019 in C.C.No.104 of 2017 on the file of the II Special Magistrate, FAC- I Special Magistrate, Rajendranagar, imposed a condition on the petitioner to deposit 20% of the cheque amount before the trial Court.

Since the Court below, after taking into consideration the material on record, imposed the aforesaid condition while suspending the sentence of imprisonment, I am not inclined to interfere with the said order. However, in view of the request made by the learned counsel for the petitioner, time for deposit of 20% of the cheque amount, as directed by the Court below, is extended for a period of eight weeks from today. No further extension of time will be granted.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
