HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41496 OF 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the 2nd respondent to release the vehicle of the petitioner.

Heard and perused the material available on record. The main grievance of the petitioner is that he is the owner of the vehicle in question viz., Eicher bearing Reg.No.AP-15-X-7682 and alleging that his vehicle was engaged for transportation of PDS rice, the 2nd respondent seized the same and registered a case in Crime No.266 of 2016. The grievance of the petitioner is that he is no way concerned with the rice involved in the above crime and if the vehicle is kept idle for a long period, there is every possibility of it getting damaged. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following directions: " The 2nd respondent is directed to release the above vehicle viz., Eicher bearing Reg.No.

AP-15-X-7682 for interim custody of the petitioner on his executing a personal bond for a sum of Rs,1,00,000/ - (Rupees One lakh only) to the satisfaction of the 2nd respondent, subject to final orders to be passed at the time of disposal of the above crime, and also on production of original R.C. book.

No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
