THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5748 OF 2016 ORDER:
This petition is filed by the petitioners-accused Nos.1 to 4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.94 of 2016 on the file of Narsingi Police Station, Cyberabad, registered for the offence punishable under Sections 447, 427, 506 and 504 IPC.
Heard and perused the material available on record. It is alleged that the 2nd respondent purchased the land admeasuring 12354.25 sq. yards in 27 plots in Sy.No.101/A. Out of the said property, the 3rd petitioner purchased 6 plots through a registered sale deed.
The 3rd petitioner sought to cancel the document.
A cancellation deed was also executed, and the possession of the property is yet to be delivered. While so, on 19.2.2016, the petitioners visited the premises and demolished the compound wall. When such action was obstructed by the employee of the 2nd respondent, the petitioners threatened him. Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by them. However, the petitioners are directed to surrender before the Station House Officer concerned on or before 5th May, 2016. On such surrender, they shall be released on bail on each of them executing a personal bond for a sum of Rs.1,000/- (Rupees One Thousand only) with one surety for the like sum each to the satisfaction of the Station House Officer concerned.
The 1st respondent-police are directed to complete the investigation, without arresting the petitioners. In the event of necessity, the 1st respondentpolice are directed to issue notice to the petitioners to appear before the investigating agency for the purpose of investigation.
