THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8948 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 4 seeking bail in the event of their arrest in connection with Crime.No.82 of 2023 on the file of Pulkal Police Station, Sangareddy District, registered for the offences under Sections 304(B) r/w. 34 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioners/A-1 and A-4 are seeking the relief of anticipatory bail. The case of the prosecution is that on 17.06.2023, the mother of the deceased lodged a complaint alleging that the deceased was given in marriage to 1st petitioner/A-1 on 13.05.2021 and dowry of Rs.13 lakhs was given. Aft 6 months of marriage, her in laws and brother-inlaw/2nd petitioner started harassing the deceased for additional dowry. Unable to bear the torture, she consumed poison on 16.02.2022. It is further alleged in the complaint

that Rs.50,000/- was given to the 1st petitioner and requested not to torture the deceased. However, the deceased committed suicide.

As seen from the remand report, there is specific allegation of harassment against the 1st petitioner/husband. Insofar as the 2nd petitioner is concerned, the allegation is that he was responsible for harassment.

In the said circumstances, this Court is inclined to grant anticipatory bail to the 2nd petitioner/A-4, subject to the following conditions:-

1) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Pulkal Police Station, Sangareddy District on 26.09.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.4 on bail, on executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.4 shall appear before the concerned Police at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

The prayer of A-1 for relief of anticipatory bail is rejected.

Accordingly, the Criminal Petition is partly allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
