HON'BLE DR. JUSTICE B. SIVA SANKARA RAO Tr.C.M.P. No.529 of 2017 ORDER:

Heard learned counsel for petitioner. Even notice served on respondent, none appeared, hence taken as heard and perused the material on record.

The Transfer petition is filed by the petitioner-wife, seeking to transfer F.C.O.P. No.53 of 2017 before the Judge, Family Court, Warangal to XVI Additional District and Sessions Judge-cumFamily Court, Malkajgiri. The said F.C.O.P. No.53 of 2017 was filed against the petitioner by her husband representing through his mother as GPA holder for the relief of Restitution of Conjugal Rights. Whereas, the petitioner herein has filed F.C.O.P. No.1821 of 2015 before the Judge, Family Court, Ranga Reddy District at L.B Nagar, for the relief of Divorce. Now it is made over to the XVI Additional District and Sessions Judge-cum- Family Court Judge, Malkajgiri with self same number.

The respondent is a software engineer staying in abroad and he is represented by his mother as GPA holder and as such inconvenience of both the ladies cannot be ignored even both the petitions are required to be tried together for common disposal of which the relief for the divorce is the efficacious relief with which the other petition can be clubbed to record evidence in said F.C.O.P. No.1821 of 2015 pending before the XVI Additional District and Sessions Judge-cum-Family Court, Malkajgiri.

Having regard to the above, the F.C.O.P. No.53 of 2017 pending on the file of Judge, Family Court, Warangal, is withdrawn

Dr.SSRB,J Tr.CMP_529_2017 and transferred to the XVI Additional District and Sessions Judgecum-Family Court, Malkajgiri to be tried along with F.C.O.P. No.1821 of 2015. The trial Judge shall not require personal appearance of the parties, if represented through advocates, but for any reconciliation and giving of evidence. 4.

With the above directions and observations, the Tr.C.M.P. is allowed.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
