HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.1930 of 2017 ORDER : (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, petitioner seeks directions thereby directing respondents 1 to 6 to produce the 11th respondent, who is friend of the petitioner i.e. Mr.S.K.Srinivas Azahar before this Court and set him at liberty. Pursuant to the order dated 20th January 2017, the 11th respondent/A3 is present in Court and has admitted that he was arrested in Crime No.27 of 2017 registered at Saroornagar Police Station, Hyderabad and released on 28th January 2017 on bail by the 11th Metropolitan Magistrate, L.B.Nagar. Thus, both the prayers made in the said petition had become infructuous.

Learned counsel appearing on behalf of the petitioner, at this stage, submits that the 11th respondent was arrested on 17th January 2017 at Visakhapatnam, however, shown as arrested on 18th January 2017 at Saroornagar, Hyderabad and the said act of 6th respondent is in violation of Section 43 of Cr.P.C. The present petition is filed by the petitioner, who is an Advocate and who claimed to be the family friend of 11th respondent, whereas the said respondent is enlarged on bail vide order dated 28th January 2017. If on any ground the aggrieved wishes to file a petition, liberty is granted. Accordingly, the present petition is disposed of without passing further orders. No costs.
