THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7125 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused seeking bail in the event of his arrest in connection with Crime No.144 of 2022 on the file of Trimulghery Police Station, Hyderabad District, for the offences punishable under Sections 385, 306, 420 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the petitioner is that he is the Managing Director of Incredible India Projects Private Limited. The victim purchased a plot on installments from the said firm and the EMI to be paid by the victim was Rs.14,800/- per month for a period of 50 months. However, when the deceased went to the office of the firm on 11.04.2022, he was informed that he has to pay an amount of Rs.24,71,190/- instead of Rs.2,21,496/-. According to the defacto complainant, after hearing the amount to be paid, the deceased went into depression and drank poison on 16.06.2022. The defacto complainant who is the wife of the deceased found a written note wherein it is mentioned that Incredible India was the reason for his death.

As seen from the complaint it is not the case of defacto complainant that the deceased met the petitioner and he was the

person who informed about payment. At no point of time, did the deceased interact with the petitioner according to the complaint. 5.

In the said circumstances, the petitioner can be granted the relief of Anticipatory bail in the event of his arrest, subject to the following conditions:

1) The petitioner/Accused is directed to surrender before the Station House Officer, Trimulghery Police Station, Hyderabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioner/Accused on bail, on his executing personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused shall appear before the concerned police every Monday between 10.00 a.m. to 1.00 p.m. for a period of 9999999eight weeks, for the purpose of investigation.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
