HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.10495 OF 2011 ORDER:

The relief sought for in this Writ Petition is for a mandamus to declare the action of the respondent in trying to dispossess the petitioners from their lands in Vagoddugudem village, Aswaraopet Mandal, Khammam District, without following the procedure established by law, as arbitrary and illegal. By way of interim relief, the petitioner sought a direction to the respondent not to interfere with their peaceful possession of the subject lands. The interim relief, sought for, was granted by order in WPMP No.12894 of 2011 dated 18.04.2011. As the petitioners' complaint is of their being forcibly dispossessed by non-tribals, and as they had the benefit of an interim order for the past more than six years, it is but appropriate that the Writ Petition is disposed of directing the respondents not to forcibly evict the petitioners from the subject land, except after putting them on notice and after giving them an opportunity of being heard. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs.
