Smt. Putumbaka Sridevi v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21837 OF 2018 O R D E R :
This writ petition is filed challenging the action of the respondent Nos.2 to 4 in not registering the complaint of the petitioner dated 30.04.2018 and not proceeding with the investigation against the unofficial respondents. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that the petitioner gave complaint dated 30.04.2018 before the 3rd respondent against respondent Nos.5 to 8; that the 3rd respondent forwarded the same to the 4th respondent on 15.05.2018; that on receipt of the said complaint, the 4th respondent made an entry No.17 in volume No.III in the General Diary Register. It is also stated that the 3rd respondent has also forwarded the complaint of the petitioner to the 'Call Money Cell' at Vijayawada, which looks into the grievances of call money cases.
It is not known why the respondents are not taking action against the complaint of the petitioner dated 30.04.2018. The Apex Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1 has issued guidelines for registration of crimes in respect of cognizable offences.
In view of the above, this writ petition is disposed of directing the competent authority to take appropriate action on the complaint of the petitioner, in terms of the aforesaid Judgment rendered by the Supreme Court in Lalita Kumari's case. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
