THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7262 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.01 of 2021 pending on the file of Abdullapurmet Police Station, Rachakonda registered for the offence under Section 20(b)(ii)(C) of NDPS Act - 1985.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioner was arrested on 14.04.2022. The case against this petitioner is that on 01.01.2021 i.e. 15 months prior to the arrest one Swift car was stopped at ORR Pedda Amberpet when the police conducting vehicle checking, the person who was driving the car had escaped. Later it was found that the petitioner is the person who had escaped on the said day.

Learned counsel for the petitioner submits that the charge sheet is already filed and the petitioner has been falsely implicated though he was available at his residence.

On instructions learned Assistant Public Prosecutor submits that there are no other cases pending against this petitioner, however, since the petitioner is the resident of Rajasthan State, the bail has to be denied.

In the said circumstances, for the reason of the charge sheet being filed, the petitioner can be granted the relief of regular bail. 7.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each among which one local and one native surety to the satisfaction of Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District.

ii) The petitioner/Accused shall appear before the concerned Court on every date of hearing without fail, failing which the

prosecution is at liberty to seek cancellation of bail granted to this petitioner/Accused.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
