HONOURABLE SRI JUSTICE T.AMARNATH GOUD CIVIL REVISION PETITION No.2693 of 2019 ORDER:

This Civil Revision Petition is filed by the petitioner under Article 227 of the Constitution of India to set aside the order dated 31.07.2019 passed in Transfer O.P.No.8 of 2019 by the Principal District Judge, Nalgonda.

Heard learned counsel for the petitioner and perused the material on record.

A perusal of the material on record shows that the parties and the suit schedule property are one and the same in O.S.No.59 of 2008, on the file of V Additional District Judge, Bhongir, which was filed for declaration of title and recovery of possession and OS.No.173 of 2010 on the file of Principal Junior Civil Judge, Bhongir, which was filed for specific performance of contract. In view of the same, the Civil Revision Petition is allowed by setting aside the impugned order passed by the lower Court in dismissing the Transfer O.P.No.8 of 2019 and said Tr.O.P.No.8 of 2019 is allowed by transferring the O.S.No.173 of 2010 from the file of Principal Junior Civil Judge, Bhongir to the file of V Additional District Judge, Bhongir, to try the same along with OS.No.59 of 2008 in the interest of justice.
