Heard Sri K.S.R.Murthy, learned counsel appearing for the petitioners and Government Pleader for Revenue. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not considering and forwarding the applications of the petitioners for regularization of their respective plots in Sy.No.86 Part situated at Gajuwaka Village and Mandal, Visakhapatnam District, as per G.O.Ms.No.44, Revenue (Assignment-I) Department, dated 11.01.2008, as illegal, arbitrary and un-constitutional; and consequently direct the respondents to consider the applications made by the petitioners.
Though various grounds are raised in the writ petition, learned counsel for the petitioners submits that since the issue in the present case is similar to one in W.P.No.20744 of 2012, the same order may be passed in the present writ petition also. Government Pleader for Revenue submits that he has no objection for the same.
Since the issue in the present writ petition is identical to the case in W.P.No.20744 of 2012, the present writ petition is disposed of permitting the petitioners to protect their plots in Sy.No.86 Part by raising a barbed wire fencing subject to the condition that the same shall be removed in case of any adverse order being passed against them by the authority before whom the applications are pending consideration. It is made clear that
the petitioners shall not claim any equity over the said plots at a later point of time. It is needless to mention that it would be appropriate, if the Collector before whom the applications are pending, shall dispose of the same as early as possible, preferably within a period of twelve weeks from the date of receipt of a copy of the order.
