ORDER:

Petitioner is working as Head Constable in Railway Protection Force. While he was posted to Waltair division and working in Visakhapatnam, by proceedings dated 05.09.2017, he was temporarily attached to Railway Protection Force (RPF) Post/ CHE (Srikakulam Road). Petitioner joined there and has been working.

Learned counsel for petitioner submits that petitioner fell sick and was hospitalized for long time. Petitioner requires consistent medical check-up and treatment. Therefore, on 16.05.2018 representation was made requesting the Senior Divisional Security Commissioner, Railway Protection Force, East Coast Railway to return the petitioner to Headquarters at Visakhapatnam on health grounds. Alleging inaction on the said representation and causing hardship and suffering because of health problems he is facing, this writ petition is filed. 3.

When the matter is taken up for consideration, learned counsel for petitioner as well as learned Standing Counsel agree for final disposal of the writ petition by directing the competent authority to examine the claim of petitioner for posting him back to Headquarters, Visakhapatnam and to pass orders thereon. 4.

Having regard to the same, Writ Petition is disposed of, without expressing any opinion on merits, directing the Senior Divisional Security Commissioner (4th respondent) to examine the claim of petitioner, as ventilated in the representation dated

16.05.2018, and to pass appropriate orders as warranted by law as expeditiously as possible, preferably within a period of three weeks from the date of receipt of copy of this order. Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
