THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8965 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A-1 in connection with Crime No.428 of 2023 on the file of Begumpet Police Station, Hyderabad, registered for the offences punishable under Sections 376(2) (n), 420 and 506 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant filed a complaint alleging that she is in relation with this petitioner since two years. One of her friend named Pulla Reddy introduced him. Further, the petitioner had sexual intercourse with de-facto complainant several times. She also became pregnant and without her knowledge, the petitioner gave tablets resulting in abortion. He had photographs and videos of the de-facto complainant. When asked to return the said material, he refused to do so and sent the same to

his friends and others, for the said reason, the complaint on 16.08.2023.

Learned senior counsel appearing for the petitioner would submit that on 19.06.2023, a complaint was in fact lodged by this petitioner against the de-facto complainant and her relatives for extortion, criminal intimidation and causing hurt. The said complaint was registered by the Nandi Giridhama Police Station, Chickballapur Taluk. The de-facto complainant and others were remanded to judicial custody and bail was granted by the concerned Court. After two months of the said assault on the petitioner, the present complaint was filed.

Keeping in view that there are differences between the petitioner and the de-facto complainant, further the complaint was filed against the de-facto complainant and others for assaulting the petitioner, petitioner can be granted anticipatory bail, subject to the following conditions:

1) The petitioner/A-1 is directed to surrender before the Station House Officer, Begumpet Police

Station, Hyderabad, on 26.09.2023. On such surrender, the said Station House Officer shall release the petitioner/A-1 on bail, on his executing personal bond for a sum of Rs.50000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A-1 shall appear before the concerned Station House Officer at 10:00 a.m on every Monday and Wednesday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioner/A-1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
