AMARNATH GOUD WRI T PETI TI ON No.34264 of 2017 ORDER: (per Justice Sanjay Kumar) The petitioner seeks a Writ of Habeas Corpus directing the Station House Officer, Medchal Police Station, to produce his wife, Panjagari Swetha, who is allegedly being detained by her parents, respondents 5 and 6 herein.
Sri J. Sai Krishna, learned counsel attached to the office of the learned Additional Advocate General, State of Telangana, informed the Court that the alleged detenu along with her parents is present in Court. Thereupon, this Court examined the alleged detenu who produced her Aadhar Card in proof of her identity. She categorically stated that she did not wish to be with the petitioner and that she was willingly staying with her parents. The petitioner is also present in person. In the light of the statement made by the alleged detenu to the effect that she is not being held against her will, no cause is made out for exercise of jurisdiction to issue a Writ of Habeas Corpus. The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed.
