No.

587 of 1999 on the file of the Motor Accidents Claims Tribunal - cum - II Additional District Judge, West Godavari District at Eluru (for short 'the Tribunal') on contest the Tribunal awarded Rs.20,000/- with interest at 12% per annum by an award dated 11.02.2004, impugning the same, the insurer maintained the appeal with the contentions in the grounds of appeal that the very claim is not maintainable and there is violation of policy and permit and the Tribunal ought not to have awarded the said amount and the claim is excessive so also the rate of interest, hence to allow the appeal. 2.

Whereas it is the contention of the counsel for 1st claimant/ 1st respondent to the appeal that respondents 2 and 4 driver and financer of the jeep even shown in the appeal as not necessary parties initially and also the owner-3rd respondent to the appeal remained ex parte before the Tribunal subsequently and following the decision in Meka Chakradhara Rao vs Yelubandi Babu Rao that the award of the Tribunal holds good and for this Court while sitting in appeal there is nothing to interfere, hence to dismiss the appeal. Perused the material on record. The parties hereinafter are referred to as arrayed before the Tribunal for the sake of convenience in the appeal. 3.

Now the points that arise for consideration in the appeal are: Whether the claim is not maintainable and the compensation awarded by the Tribunal is unsustainable so also the quantum and rate of interest and claim otherwise not maintainable and with what compensation and with what observations for this Court while sitting in appeal? To what result? POINT-1: 4. There is no dispute as to the manner of accident and outcome of rash and negligent driving of jeep driver which resulted the petitioner sustaining injury. It is there from the Tribunal awarded compensation of Rs.20,000/- with interest at 12% per annum holding that Ex.B1-policy is also admittedly in force and it covers the risk. The evidence of RW.1 no doubt shows that the policy is issued for private purpose and PA is collected covering the risk for 10 persons to maximum of Rs.

50,000/- each by collecting annual premium of Rs.50/- each, other than personal accident coverage to the driver and there by for the inmates, there is no coverage of risk and even otherwise under the PA coverage, the injured is not a third party to maintain the claim. In fact, a perusal of the policy shows the additional premium collected as PA for 10 persons at Rs.50/- each. Even the contention that the vehicle is insured for personal use and not for hire as a passenger jeep and PA risk not covered to claim as third parties, but for to approach consumer forum or other forum, said contention for no substance, this Court is not chosen to disturb the compensation awarded for the injuries of Rs.20,000/-.

Once, the claimant is entitled, but for the contention of again to approach some other forum, which gives lift to litigation further with time and expense to both sides; but for to reduce the rate of interest from 12 % per annum to 7.5% per annum vide TN Transport vs Raja Priya and Rajesh vs Rajbir Singh from the date of petition till the date of realisation. 5. Accordingly, point No.1 is answered. Point No.2 6. In the result, the appeal is partly allowed by confirming the compensation awarded by the Tribunal of Rs.20,000/- and reducing the rate of interest from 12% per annum to 7.5% per annum from the date of petition till the date of realisation.
