HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12557 of 2015 ORDER:
When the matter is taken up for hearing, learned Standing Counsel appearing for the respondents submits that the petitioner has involved in the theft of electricity and this Court was pleased to grant interim order on 28.04.2015 on condition of the petitioner depositing 50% of the demanded amount and the said interim order is not complied with. Therefore, the cause in the writ petition does not survive for adjudication.
Today, despite the matter being listed under the caption " FOR DISMISSAL" , when the matter is taken up for hearing, none appears for the petitioner and there is no representation on its behalf.
In view of the above submission made by the learned Standing Counsel, this Court is of the considered view that the cause in the writ petition does not survive for adjudication and has become infructuous.
Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
