This writ petition is filed seeking a direction to the respondent to prepare seniority list in the cadre of Assistant Executive Engineers. 2.

The grievance of the petitioner is that he is fully eligible and qualified to be promoted as Deputy Executive Engineer, but because of the inaction of the respondent in not preparing the seniority list in the cadre of Assistant Executive Engineers, the case of the petitioner is not being considered for promotion to the post of Deputy Executive Engineer. 3.

Learned Standing Counsel appearing for the respondent contends that during the pendency of the Writ Petition, the petitioner was promoted as Deputy Executive Engineer and hence, the cause in the Writ Petition does not survive and seeks to dismiss the Writ Petition. 4.

This Court, having considered the rival contentions is of the considered view that this Writ Petition can be disposed of directing the respondent to prepare seniority list in the cadre of Assistant Executive Engineers, if not prepared already, within eight weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of with the above observations. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
