ORDER
This writ petition is filed seeking to declare the proceedings No.K/4941/2016 dated 25.04.2016 issued by the 2nd respondentRevenue Divisional Officer, Karimnagar, as illegal and untenable.
2. It is the case of the petitioner that he is a fair price shop dealer in Shop No.0706 situated at Choppadandi Village and Mandal, Karimnagar District. It is stated that after conducting inspection, the Deputy Tahsildar (CS) reported that they found variation of stock and that the petitioner was indulging in clandestine business by not distributing the essential commodities to the cardholders properly and diverting the stock into black market, thereupon, the second issued the impugned show cause notice dated 25.04.2016, for which, the petitioner has submitted his detailed explanation on 28.04.2016. The grievance of the petitioner is that even though he submitted his explanation, no enquiry has been conducted till date. Hence, he filed the present writ petition.
3. The specific contention of the learned counsel for the petitioner is that the petitioner cannot be placed under suspension pending enquiry for a prolonged period.
4. Learned Government Pleader for Civil Supplies submits that the respondents may be directed to complete the enquiry within a stipulated period.
5. The impugned show cause notice would show that on physical verification of the stocks available on ground in the shop of the petitioner, the authorities found variation of 107 litres of kerosene. In view of the same, the second respondent issued the impugned show cause notice, for which, the petitioner has submitted his explanation on 28.04.2016. Considering the facts and circumstances of the case, the second respondent is directed to complete the enquiry taking into consideration the explanation submitted by the petitioner and after giving due opportunity to the petitioner and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed. _______________________ CHALLA KODANDA RAM, J 20th June, 2016 Note:
