THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.24953 of 2019 ORDER:

The present writ petition is filed to declare the action of the respondents in summoning the petitioners regularly to the police station and detaining them hours together without there being any case registered against them, as illegal and arbitrary. 2.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home.

3.

Learned Assistant Government Pleader for Home, on written instructions, dated 14.11.2019, a copy of which is placed on record of this Court, submits that based on the complaint of one Yadla Kotireddy, a case was registered against the brother of the petitioners, in Crime No.243 of 2019 for the offences punishable under Sections 406 and 420 IPC on the file of Huzurnagar Police Station, on 06.10.2019, wherein the brother of the petitioners is arrayed as accused No.1. Since the efforts to locate accused No.1 have failed and as the whereabouts of the said accused person were not available, the official respondents contacted the petitioners for obtaining the information relating to whereabouts of accused No.1 in the said case. Learned Assistant Government Pleader further submits that the authorities have denied that the petitioners were called to the police station and were detained for hours together in the police station. Learned Assistant Government Pleader contends that the respondent police never called the petitioners to the police station nor detained them.

4.

In the light of the submissions made by the learned Assistant Government Pleader on behalf of the official respondents that the respondent police only contacted the petitioners, being family members of accused No.1, to know whereabouts of accused No.1 and the respondent police never detained the petitioners in the police station, this Court is of the view that no further orders are required to be passed in the writ petition.

5.

Recording the above submissions, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
