THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.25910 OF 2002 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus to declare the action of the respondent in withholding the payment of gratuity payable to the petitioner on the ground that the disciplinary enquiry initiated against him is pending as illegal and arbitrary and without any authority.

After arguing for sometime, learned counsel for the petitioner requested the Court to direct the respondent herein to consider the representation, dated 17.12.2002, of the petitioner and pass appropriate orders. Learned Standing Counsel appearing for the respondent also submitted that the respondent will consider the said representation in accordance with law.

Considering all the facts and circumstances of the case, the respondent is hereby directed to consider the representation, dated 17.12.2002, of the petitioner and pass appropriate orders in accordance with law, as expeditiously as possible. 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
