THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.13673 of 2006 ORDER :

This writ petition is filed by the petitioner on the apprehension that the respondents may interfere with the possession of the lands allotted to the petitioner by the Ex.Servicemen Cooperative Farming Society, Tadepalligudem in respect of the lands in R.S.Nos.136, 135 and 103 to an extent of Acs.5.00 cents situated at Tadepalligudem air field land under allotment certificate General No.220, dated 04-12-1984, without following the due process of law.

The petitioner could not substantiate the interference by the respondents with the possession of the lands allotted to the petitioner by way of filing any order or stating any act which necessitated the petitioner to approach this Court, but, in any event, in the interest of justice, this Court is of the view that this Writ Petition can be disposed of with the following observation :

3. If the respondents intend to take possession of the lands belong to the petitioner herein, on being proved such possession by the petitioner, the respondents are directed to take action by following the due process of law.

4. With the above observation, the Writ Petition is disposed of.

No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this Writ Petition are closed.
