THE HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.7345 of 2015 ORDER:

The petitioner is an Educational Institution providing Under Graduate, PostGraduate and other Diploma Courses in Kaikaluru, Krishna District. It is submitted by the petitioner that since its inception, the 2nd respondent - University, among others, has allotted the petitioner's College as one of the examination centres for conducting regular yearly examinations for Under Graduate and Post-Graduate courses. For the year 2015, the University issued a notice of UG Examination Centres for March/April 2015, whereby the petitioner was allotted to conduct examinations for the students of Suguna Degree College, Kalidindi and Y.V.N.R. Government Degree College, Kaikaluru. Nextly, it is submitted that the petitioner has already been conducting regular examination for I year UG (B.A./B.Com/B.Sc.) from 02.03.2015 to 19.03.

2015 and has submitted its D-forms and other relevant documents to the 2nd respondent. While so, it is said that the 3rd respondent has issued a circular No.KRU/Exams/Centre Change/2014 dated 16.03.2015, whereby the 2nd respondent - University arbitrarily changed the examination centre for II year UG theory examinations scheduled to be held from 23.03.2015, from the petitioner-College to one YVNR Government Degree College, Kaikaluru. The aforesaid circular is challenged as arbitrary and illegal in the present writ petition and the same was sought to set aside by allowing the petitioner - College to conduct the examination.

I have heard learned counsel for the petitioner and learned Standing Counsel for the University.

On instructions, learned Standing Counsel for the 2nd respondent - University submitted that in the 1st phase of UG examinations March 2015 for I and III years were conducted at two centres, namely Vidyanjali Degree & PG College, Kaikaluru and YVNR Government Degree College, Kaikaluru for 895 students, and in the 2nd phase of UG examination March 2015 for II year students was initially to be

conducted at two centres i.e. Vidyanjali Degree & PG College, Kaikaluru, and YVNR Government Degree College, Kaikaluru. According to the 2nd respondent, as per the note submitted, in the 2nd phase, only 419 students are appearing between 23.03.2015 and 06.04.2015 and therefore, two centres were absolutely unnecessary and one centre would be sufficient. Keeping in view the number of students appearing for examination, it is said that the University thought to conduct examination only in YVNR Government Degree College, Kaikaluru for the 2nd phase. It is further submitted on behalf of the University that the change of centre was intimated to the II year students by way of circular, dated 16.03.2015, notified in the website of the University, press notification and through the respective Principals of Colleges.

Learned counsel appearing for the petitioner submits that the petitioner - College has the centre of examination, and the same was already communicated to the students, and therefore, there will be confusion among the students about the centre. Since the University has already notified in the website and also issued a press notification, this Court is of the view that there cannot be any scope for such confusion. Further, it is a prerogative of the University to select the examination centre and the petitioner - College has no locus standi to insist upon the conducting of examination in the petitioner - College itself. Absolutely, I see no merit in the writ petition and it is accordingly dismissed at the stage of admission. No order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
