THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7133 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A4 seeking bail in the event of his arrest in connection with Crime No.569 of 2022 on the file of Kusaiguda Police Station, Rachakonda, registered for the offences punishable under Sections 420, 406, 506, 120-b of Indian Penal Code and section 5 of T.S.Protection of Depositors Financial Establishment Act, 1999.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the police, Kusaiguda registered the present complaint for the offence of cheating and also under T.S.Protection of Depositors Financial Establishment Act, 1999.

The allegation against this petitioner is that he had asked the complainant to deposit the amount with Accused No.1 and others. For the said reason the petitioner is arrayed as Accused

No.4 in the FIR and as Accused No.6 in the Remand Report of Accused Nos.1 to 4.

As seen from the complaint, this petitioner had introduced the complainant to the accused. However, learned counsel for the petitioner had filed an undertaking given by Accused No.1 that he had invested an amount of Rs.17,50,000/- for which Accused No.5 had issued four cheques drawn at different banks. Further, this petitioner was also shown as respondent in the I.P.No.90/2021 filed by Ms.Sajja Lakshmi/A3.

In the said circumstances, since this petitioner also invested in the firm of Accused, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the criminal petition is allowed and the petitioner/A4 shall be enlarged on bail in the event of his arrest, subject to the following conditions:

1) The petitioner/A4 is directed to surrender before the Station House Officer, Kusaiguda Police Station, Rachakonda District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioner/A4 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/A4 shall appear before the police every Tuesday between 10.00 a.m. to 1.00 p.m. for a period of eight weeks, for the purpose of investigation.

3) The petitioner/A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
