The petitioner is aggrieved by the action of the 4th respondent in complying with the orders of 2nd respondent in Appeal No.10979/CIC/2018 dated 21.08.2019, and consequently seeks a direction to the 4th respondent to implement the orders passed by the 2nd respondent in the said appeal.
Learned counsel for the petitioner submits that there is no response from the 4th respondent PIO, and only a part of the information was furnished in response to his application under the Right to Information Act, 2005. Per contra, learned Government Pleader for General Administration Department submits that by letter dated 16.11.2019, the information sought by the petitioner for the period 2014-15 to 2018-19 was furnished and likewise the information for the year 2013-14 also was furnished.
Though learned counsel for the petitioner submits that only a part of the information was furnished and the remaining information has not been furnished on account of the fact that some record is not available with the 4th respondent, however, it is also his assertion that pursuant to the application made by him on 12.10.2018, the 3rd respondent, who is the appellate authority, required the petitioner to pay the requisite fee which is a sum of Rs.18,000/- for furnishing the information. As the 3rd respondent-appellate authority is ready to furnish the information sought by the petitioner on payment of requisite fee which was admittedly communicated to the petitioner, liberty is given to the petitioner to comply with the same if he desires to obtain the information.
The writ petition is accordingly disposed of. No costs. Miscellaneous petitions, if any pending, shall stand closed.
