THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7147 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A5 in connection with Crime No.245 of 2022 on the file of Siricilla Police Station, Rajanna Siricilla District, registered for the offences punishable under Sections 120-B, 143, 147, 302, 324, 506 read with 149 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he is a Reporter in a news TV channel. The allegation against this petitioner is that this petitioner and the victim went to market place where other accused were waiting and after the petitioner left, the other accused surrounded the victim and beat him indiscriminately for which reason, the victim succumbed to injuries.

Learned Counsel for the petitioner submits that even according to the complaint, the petitioner did not cause any injuries and any overtacts are attributed to him. 5.

It is the case of prosecution that both went to the market place and the other accused had attacked the victim. 6.

On the other hand learned Assistant Public Prosecutor submits that the petitioner had taken the victim to the said place in a premeditated manner and the other accused had attacked the deceased.

However, keeping in view that the investigation is almost complete and material witnesses are examined, the petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A5 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Principal Judicial Magistrate of First Class at Siricilla. ii) The petitioner/A5, after release shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.00 A.M. to 1.00 P.M. for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii) The petitioner/A5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
