V.Praveen, v. The State Of Telangana,
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.GANGA RAO Writ Appeal Nos.1519, 1520 and 1521 of 2017 COMMON JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} After arguing for some time, Sri G.Vidya Sagar, learned Senior Counsel appearing on behalf of the respondent-Corporation, would submit that it would suffice, instead of adjudicating these appeals on merits, if the Corporation is permitted to issue show cause notices to the appellants, give them an opportunity of being heard, and thereafter pass orders afresh in accordance with law. He would only request this Court to specify a time frame within which the appellants should submit their reply to the fresh show cause notices. Sri C.
Ramachandra Raju, learned counsel for the appellants, would fairly state that the appellants would submit their reply to the fresh show cause notices within two weeks from the date of its receipt. As both the learned counsel are in agreement, the order under appeal is set aside, permitting the respondent-Corporation to issue fresh show cause notices to the appellants. On receipt of these notices the appellants shall submit their reply thereto within two weeks thereafter. The respondents shall then pass reasoned orders afresh in accordance with law.
The Writ Appeals are, accordingly, allowed. Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs.
