THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24966 of 2019 ORDER:

It is the case of the petitioners that their land admeasuring Acs.5.35 guntas in Survey Nos.320/A, 320/AA and 320/E of Hindupur Village, Krishna Mandal, Narayanpet District, was acquired pursuant to the preliminary notification dated 04.06.2019 issued under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'), for the purpose of construction of railway station and for laying a broad gauge line near Hindupur Village; that they submitted their objections on 31.07.2019 pursuant to the notice issued under Section 15 of the Act and that no declaration under Section 19 of the Act was published and no Award was passed, but, the respondent authorities are directing them to handover the possession of the subject land for execution of the proposed work.

Learned Government Pleader for Land Acquisition, on instructions, submits that necessary procedure as mandated in law would be followed and possession of the subject land would be taken only after payment of the compensation as mandated under Section 38 of the Act.

CKR, J W.P.No.24966 of 2019 Recording the aforesaid submission, this Writ Petition is disposed of.
