THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7129 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.602 of 2022 on the file of Station House Officer, Meerpet Police Station, Vanasthalipuram registered for the offences punishable under Sections 342, 376(2)(n) and 506 of Indian Penal Code and Section 5(l) read with Section 6 of POCSO Act, 2012. 2.

Heard learned counsel for the petitioner/Accused and the learned Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that the victim girl was kidnapped and married to this petitioner in the year 2018. Later the petitioner impregnated her and when she went to her parents' house for delivery, the petitioner went to Bangalore, since then he was not responding to the phone calls of the victim and he has also taken house documents and gold ornaments along with him.

Learned counsel for the petitioner submits that earlier the petitioner had lent an amount of Rs.23,80,000/- and Rs.27,00,000/- on two occasions to the father of the victim, for which reason the present false implication.

Learned Assistant Public Prosecutor on instructions would submit that the investigation is complete and charge sheet is already filed.

In the said circumstances, this Court is inclined to grant bail to the petitioner/Accused. Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Special Sessions Judge for Trial and Disposal of Cases under POCSO Act, Ranga Reddy District at L.B.Nagar.

ii) The petitioner/Accused shall appear before the concerned Court on every date of hearing, failing which the bail granted to this petitioner/Accused is liable to be cancelled.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
