CVNR, J & GSP, J W.P.No.17651 of 2016 28.09.2016 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for a mandamus to declare the action of the respondent bank in initiating recovery proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, in respect of two undivided and unspecified residential sites admeasuring 1040 sq. yds. each at D.Nos.324/C and 323D of Gorantla Village, Guntur District, by way of sale notice, dated 30.04.2016, fixing the date of auction as '09.06.2016' pending disposal of S.A.No.31 of 2016 on the file of the Debts Recovery Tribunal, Visakhapatnam, as illegal and arbitrary.

At the hearing, Mr.M.Sapthagiri, learned counsel representing Mr.K.B.Ramanna Dora, learned counsel for the petitioner, has requested for permission of the Court to withdraw the writ petition. 3.

The Writ Petition is, accordingly, dismissed as withdrawn. 4.

As a sequel to dismissal of the writ petition, interim order, dated 07.06.2016, in W.P.M.P.No.21700 of is vacated and W.P.M.P.No.21700 of 2016 filed by the petitioner for interim relief shall stand dismissed as infructuous.
