HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23607 OF 2016 ORDER:

Heard the learned counsel for the petitioner, the learned Government Pleader for Land Acquisition for respondents 1 and 3 and Sri S.S.Varma, learned Standing Counsel for National Highways.

2. Learned counsel for the petitioner submits that no technical person is appointed for assessing the compensation, as envisaged under Section 29 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and the petitioner is entitled for compensation under the provisions of the said Act.

3. In the written instructions dated 20.07.2016 filed by the learned Government Pleader for Land Acquisition, it is stated that the Government of India issued instructions for fixation of compensation, according to the 1st Schedule to the Land Acquisition Act, 2013, for the lands acquired under the National Highways Act, 1956 and after deposit of necessary funds by the 2nd respondent with the 3rd respondent, steps will be taken for payment of compensation to the land owners and due notice will be given to the petitioner along with the others. He also submits that after consideration of the technical constraints expressed by the 2nd respondent only, the 3rd respondent passed the impugned order.

4. Recording the submissions of the learned Government Pleader, this Writ Petition is disposed of. No costs.

5. As a sequel, the miscellaneous petitions, if any, pending shall stand closed.
