THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8969 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A-1 in connection with Crime No.144 of 2023 on the file of Women Police Station, Warangal District, registered for the offences punishable under Sections 498-A, 307, 327 and 506 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1955.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner/husband is seeking anticipatory bail on the basis of the complaint registered by the Women Police Station, Warangal. It is alleged in the complaint by the wife of the petitioner that marriage was performed on 17.08.2022. At the time of marriage Rs.51 lakhs was given and thereafter reception was held at Hanumakonda. On 20.08.2022, A-1 with an intention to kill his wife pressed her neck. On 28.08.2022, the petitioner and his relatives

attacked her. Thereafter, the de-facto complainant and the petitioner started living in Hyderabad. While staying in Hyderabad he was coming home in a drunken condition and demanded additional dowry. Unable to bear the constant harassment of beating under the influence of alcohol, the complaint was filed.

As seen from the complaint, the alleged incident of throttling the de-facto complainant had taken place in Warangal in the month of August, 2022. All the other allegations are outcome of the differences between the spouses. The main allegation against this petitioner was coming home in drunken condition and abusing the de-facto complainant. Since the issues are between the spouses, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to the following conditions:

1) The petitioner/A-1 is directed to surrender before the Station House Officer, Women Police Station, Warangal District, on 26.09.2023. On such surrender, the said Station House Officer shall release the petitioner/A-1 on bail, on his

executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A-1 shall appear before the concerned Station House Officer at 10:00 a.m on every Monday and Wednesday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioner/A-1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
