HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.30642 of 2011 ORDER:
This writ petition is filed seeking a direction to the 1st respondent to remove the illegal occupations of respondents Nos.2 to 7 and to restore the passage of the petitioner.
On 18.11.2011, while ordering notice, this Court issued an interim direction to respondents Nos.2 to 7 not to make further constructions. On 13.12.2011, the said order was modified directing respondents Nos.2 to 7 to make constructions in accordance with the sanctioned plan approved by the Municipality.
When this matter has come up for hearing, there is no representation on behalf of the petitioner even though the earlier order dated 18.11.2011 was modified directing the unofficial respondents to make constructions. The learned Counsel for the unofficial respondents submitted that the unofficial respondents have already completed their constructions in accordance with the permission granted by the official respondent.
Considering the facts and circumstances of the case, this Court is of the view that nothing survives for adjudication in this writ petition. Accordingly, the Writ Petition is disposed of as infructuous. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
