THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12016 of 2017 ORDER:
This Writ Petition is filed challenging the action of respondent Nos.2 to 5 in interfering with the petitioner's two room house having a tin shed roof situated in Survey No.40/A, Thadakamalla Road, in front of Saraswathi Sishu Mandir School, Miryalaguda Town, at the instance of respondent No.6.
The averments in the affidavit filed in support of the Writ Petition show that the petitioner approached respondent Nos.4 and 5 when the sixth respondent was interfering with the said property. But, respondent Nos.4 and 5, instead of taking action against respondent No.6, started interfering with the possession of the property. No copy of the complaint lodged with respondent Nos.4 and 5 is filed along with the present Writ Petition. Hence, this Court sees no prima facie case to grant the relief sought for in the Writ Petition. However, if there is any allegation of highhandedness or misuse of power by respondent Nos.4 and 5, it is always open to the petitioner to approach respondent Nos.2 and 3, who shall take
necessary action in accordance with law, if a written complaint is filed by the petitioner.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 06.04.2017 vs
