HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.24945 of 2019 ORDER:

This writ petition is filed declaring the action of the respondents 2 to 4 in not taking any action on the illegal construction of cell tower by respondent Nos.6 & 7 at the instance of the 5th respondent in the joint property of the petitioner and the 5th respondent in survey No.269, situated at Madaka Village, Odela Mandal, Peddapalli District, without consent of the petitioner, as illegal and arbitrary.

Heard learned counsel for the petitioner and learned Government Pleader for Panchayat Raj for the respondents 1 to 3 and also Sri G. Narender Reddy, learned Standing Counsel for the Gram Panchayat for the 4th respondent.

Sri G. Narender Reddy, learned Standing Counsel for the Gram Panchayat submits that permission has been granted for erection of cell tower basing on Form-1B showing the property in the name of the 5th respondent.

Learned counsel for the petitioner wanted to file a fresh writ petition to challenge the same.

In view of the above submissions, this Writ Petition is disposed of by granting liberty to the petitioner to challenge the said permission in accordance with law.
