The criminal petition is filed seeking quash of the proceedings in CC.No.72 of 2010, against the petitioners, who are A3 to A7, on the file of the Additional Junior Civil Judge cum Special Judicial First Class Magistrate (Mobile), Kamareddy. The offences alleged are under Sections 498-A and 323 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the first respondent. None appears for the second respondent.

Originally the complaint was filed against the petitioners also but in the charge sheet their names were deleted, against which a protest petition was filed and the Court below by virtue of a detailed order took cognizance of the case.

The counsel for the petitioners submits that earlier in the charge sheet the Investigating Officer found that there was no case made out against the petitioner and as such, their names were deleted. 5.

A perusal of the order of the Court below shows that the Court below has meticulously considered the submissions of the complainant wherein it was stated that the petitioners herein were involved in the harassment meted out to her. In view of the same, this Court opines that this is not a fit case for quash of proceedings against the petitioners.

The criminal petition is dismissed.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed. __________ T. RAJANI, J November 30, 2018 DSK
