THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13957 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.134 of 2015 on the file of Ponduru Police Station, Srikakulam District, registered for the offence punishable under Sections 417 and 376 IPC.

It is alleged that the petitioner induced the de facto complainant, who is a married woman by informing that he is ready to marry her, if she gives divorce to her husband. The de facto complainant gave divorce to her husband and had sexual relationship with the petitioner and thereafter, when the de facto complainant compelled the petitioner to marry, he refused and informed her that he is ready to keep her as his second wife. Aggrieved over the same, the de facto complainant lodged the present complaint.

Considering the facts and circumstances of the case and the nature of the allegations, this Court is not inclined to grant anticipatory bail to the petitioner.
