HCJ & AAR, J W.P. No. 25133 of 2019 Dt: 20-11-2019 Order: (per Hon'ble The Chief Justice Raghvendra Singh Chauhan) This writ petition has been filed ostensibly on the ground that the petitioner's elder sister, namely Ms. Neelam Mahalakshmi (for short 'the detenue'), is being illegally detained by respondent No. 5, Mr. G.B.S. Bhatt.

According to the petitioner, the whereabouts of the detenue were unknown. The petitioner was informed that she was being kept in a nursing home for the old people. Despite the fact that she has been trying to contact the detenue, respondent No. 5 is refusing to allow her to talk to her own sister i.e., the detenue. Therefore, according to the petitioner, the detenue is being illegally detained by respondent No. 5. By order dated 15-11-2019, this Court had directed respondent No. 4, the Station House Officer, Meeerpet Police Station, to find out whether the detenue was alive or not ? This Court had also directed respondent No. 5 to produce the detenue before this Court. Consequently today, respondent No. 5 has produced the detenue before this Court. This Court had an occasion to speak to the detenue, namely Ms. Neelam Mahalakshmi. She informs this Court that she has

HCJ & AAR, J W.P. No. 25133 of 2019 Dt: 20-11-2019 nothing to do with her sister, the petitioner; she has no desire to talk to her, and to live with her. According to her, she is living with respondent No. 5 out of her own free will. She is being looked after well by respondent No. 5 and his wife. Therefore, she will have nothing to do with the petitioner. Since the detenue herself claims that she is living out of her own free will with respondent No. 5, obviously, the custody of the detenue with respondent No. 5 cannot be said to be an illegal one. Therefore, respondent No. 5 is directed to take the detenue, namely Ms. Neelam Mahalakshmi, back to his home, and to look after her well.

Accordingly, the writ petition stands disposed of. As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
