THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8983 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A-1 in connection with Crime No.271 of 2023 on the file of Karimnagar Rural Police Station, Karimnagar District, registered for the offences punishable under Section 306 r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner is seeking anticipatory bail on the allegation of abetting suicide by her husband. The complaint was lodged on 20.08.2023 by the father-in-law of this petitioner alleging that marriage of this petitioner with his son was performed 10 years ago and were having four children. The petitioner was having illegal intimacy with another person namely Chityala Kishan even prior to marriage and thereafter also. Though the deceased and the de-facto complainant asked to change her attitude, she

did not change. For the said reason, the husband/this petitioner committed suicide.

Prima facie, having relation outside marriage would not amount to abetting commission of suicide. In the present facts of the case, since nothing is alleged apart from saying that she had relation, she can be granted anticipatory bail, subject to the following conditions:

1) The petitioner/A-1 is directed to surrender before the Station House Officer, Karimnagar Rural Police Station, Karimnagar District, on 27.09.2023. On such surrender, the said Station House Officer shall release the petitioner/A-1 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A-1 shall appear before the concerned Station House Officer for the purpose of investigation, as and when required.

3) The petitioner/A-1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C

and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
