THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7144 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.4 in the event of her arrest in Crime No.92 of 2022 on the file of Station House Officer, Shanthi Nagar Police Station, Jogulamba-Gadwal District registered for the offences punishable under Sections 304-B and 498-A read with Section 34 of Indian Penal Code and Sections 3, 4 and 6 of Dowry Prohibition Act. 2.

Heard learned counsel for the petitioner/Accused No.4 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the petitioner is the cousin sister of Accused No.1 whose wife committed suicide by consuming pesticide.

As seen from the complaint, there are no specific allegations against this petitioner except stating that there was a demand of additional dowry by the husband of the deceased and also the

sister-in-law who is the present petitioner. For the reason of there being omnibus allegation of demand of additional dowry on behalf of Accused No.1, this petitioner/Accused No.4 who is already married and living separately, she can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.4 shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Shanthi Nagar Police Station, JogulambaGadwal District within ten days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction. ii) The petitioner/Accused No.4 shall appear before the investigating authorities as and when required. iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. s
