THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9120 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in SC.NDPS No.83 of 2022 on the file of Metropolitan Sessions Judge, Hyderabad, registered for the offence under Section 8(c) r/w. 20 (b) (ii) (B), of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner is facing trial for the offence under NDPS Act. During the course of trial, the petitioner failed to appear before the trial Court on 01.08.2023. The learned Sessions Judge issued non-bailable warrants and the said warrants were executed on 07.08.2023 and the

petitioner was remanded to judicial custody by the learned Sessions Judge.

Learned counsel for the petitioner submits that the reason for his non-appearance is on account of his attendance in a funeral of a close relative.

Keeping in view the Court below had granted bail to the petitioner pending trial and on one occasion the petitioner absented himself without representation, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of I Additional Metropolitan Sessions Judge, Hyderabad.

ii) The petitioner/Accused after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
