HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1732 OF 2017 ORDER:

The case of the petitioner is that he was assigned a house site admeasuring Ac.0-03 cents in S.No.64 and 65 of Purini Village vide proceedings in Rc.B.143/98 dated 05.01.2011. While so, the 3rd respondent issued notice dated 21.06.2016 under Section 7 of the A.P. Land Encroachment Act, 1905. Against the said notice, the petitioner preferred an appeal before the 2nd respondent along with stay petition. But no orders are passed in the appeal or stay petition. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that though statutory appeal is pending, the respondents are trying to interfere with the possession of the subject land.

Heard the learned Assistant Government Pleader for Revenue. Since it is stated that the statutory appeal is pending before the 2nd respondent, the 2nd respondent is directed to dispose of the appeal filed by the petitioner within a period of eight (08) weeks from the date of receipt of copy of this order. Till disposal of the appeal, status-quo obtaining as on today shall be maintained in respect of he subject land. With the above direction, the writ petition is dismissed. There shall be no order as to costs. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
