HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21788 OF 2018 O R D E R :

This writ petition is filed for a direction to the respondents 1 to 4 to act in accordance with law and forbear from interfering with the civil dispute concerned the land admeasuring Ac.11-18 guntas, out of 16-20 guntas, in Survey No.376 of Kukatpally Village, Balanagar Mandal, Ranga Reddy District.

Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the petitioners two cases were registered vide Cr.No.443/2017 under Sections 385, IPC dated 17.10.2017 and Crime No.174/2018 under Sections 447, 427, 506 IPC dated 09.05.2018, on the file of Balanagar Police Station against the 5th respondent, as they illegally interfered with the suit schedule property in OS.No.49/1989 and EP.No.53/2000; and that investigation is taken up. It is further stated that the police never interfered with the civil disputes and never threatened the petitioners that the fencing which is already existing would be removed.

Recording the aforesaid submissions of the learned Assistant Government Pleader, the writ petition is disposed

of. However, this order will not preclude the respondent police from investigating into the crimes registered and take action. It goes without saying that the respondent police shall not interfere with the civil disputes. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 29.06.2018 t k.
