HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15935 of 2004 ORDER:

When the matter is taken up for hearing, the learned Standing Counsel for the 1st respondent-University submits that during the pendency of this writ petition, the petitioner was appointed against a regular post and contend that the petitioner was challenging the absorption of respondents 3 and 4 when the petitioner was not appointed on regular basis. Now that the petitioner has been appointed in a regular vacancy, the cause in the writ petition will not survive. Learned counsel appearing for petitioner also does not dispute the above said fact.

In view of the above said submissions, this Court is of the considered view that the cause in the writ petition does not survive. It is needless to mention that if the petitioner wants any benefits on par with respondents 3 and 4, she is at liberty to submit a representation to the official respondents, upon which, the official respondents shall consider the said representation and pass appropriate orders in accordance with Rules.

With these observations, the writ petition is closed. No order as to costs.
