THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.6225 OF 2000 ORDER:

This writ petition is filed by the petitioners seeking to issue a writ of certiorari calling for the records relating to and connected with the award in I.D.No.85 of 1996, dated 17.11.1999 on the file of the 2nd respondent, and to quash the same.

On 6.12.2017, when the matter was listed under the caption 'for orders', none appeared for the petitioners, and the matter was directed to be listed on 7.12.2017. On 7.12.2017, as there was no representation the matter was adjourned to 8.12.2017, on which date also, there was no representation, and hence, the matter was directed to be listed on 11.12.2017. Today, when the matter was called in the morning, there was no representation. Then, the matter was passed over and again when the case was taken up in the afternoon session, again there is no representation on behalf of the petitioners.

As can be seen from the record, this writ petition was already dismissed for default on 13.8.2010, and on the application filed by the petitioners, the writ petition was restored on 4.8.2011. 4.
It has been contended by the learned Counsel for the 1st respondentworkman that in similar situated cases of workmen, the writ petition i.e., W.P.No.6488 of 2000 preferred by the employer-Director of Sericulture was dismissed on 25.11.2010 and that the issue in this matter is identical as in W.P.No.6488 of 2000, and since the issue involved in this writ petition is covered by the judgment in W.P.No.6488 of 2000, this writ petition may be dismissed confirming the award passed by the 2nd respondent.

Following the judgment of this Court in W.P.No.6488 of 2000, dated 25.11.2010, this Writ Petition is dismissed as it is devoid of merits. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
