HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.15079 OF 2016 ORDER:

This petition is filed seeking to quash the proceedings in C.C.No.452 of 2016 on the file of I Additional Chief Metropolitan Magistrate, Visakhapatnam for the offences punishable under Sections 498-A of I.P.C. and Section 4 of Dowry Prohibition Act on various grounds.

But during hearing, learned counsel for the petitioners requested to pass order dispensing the appearance of petitioners 2 and 3 who are in-laws of the defacto complainant before the I Additional Chief Metropolitan Magistrate, Visakhapatnam. But this court cannot pass order dispensing with the appearance of the petitioners 2 and 3 before the said court while exercising power under Section 482 Cr.P.C. , However, the petitioners 2 and 3 are permitted to file an appropriate application before I Additional Chief Metropolitan Magistrate, Visakhapatnam to dispense with the appearance of the petitioners 2 and 3 before the I Additional Chief Metropolitan Magistrate, Visakhapatnam after issuing notice to the Public Prosecutor and on filing of such application, I Additional Chief Metropolitan Magistrate, Visakhapatnam is directed to decide the application on the same day itself.

Accordingly, this Criminal Petition is disposed of.
