This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to direct the 2nd respondent to set aside the seizing of the auto rickshaw of the petitioner herein vide bearing No.TS 03 UB 3657 vide FIR No.653 of 2016 dated 06.10.2016 in Medipalli Police Station, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

Heard and perused the material available on record. 3.

Case of the petitioner is that respondent No.2 filed the aforementioned case against his friend and others for the offences punishable under Section 41(1)(d) Cr.P.C. and Section 411 I.P.C.; that he is the owner of the said auto rickshaw and the same was seized in connection with the said crime and he is no way connected with that crime.

Considering the facts and circumstances of the case, this Writ Petition is disposed of directing the petitioner to approach the Court concerned and file a petition for return of the aforesaid vehicle. There shall be no order as to costs. 5.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
