HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30166 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition is being taken up for hearing at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not conducting enquiry and not taking appropriate action on the representation, dated 11.04.2016, made by the petitioner as illegal, arbitrary and contrary to the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short " the Act" ); and consequently direct the second respondent to dispose of the representation.

3) The grievance of the petitioner is that the authorities have played fraud while deleting the name of the husband of the petitioner and other legal representatives and got incorporated the names of Chittabathula Prameela and others. 4) The Government Pleader for Revenue on instructions submits that specific procedure has been prescribed in the Act with regard to changes in the entries and the petitioner has to avail the same.

5) Learned counsel for the petitioner submits that without giving any notice to the petitioner, the entries were changed at the instance of one K.Malleshwara Rao.

6) In view of the submission made by the learned counsel for the petitioner that the petitioner came to know about the changing of entries recently, the petitioner is directed to make an appropriate application before the District Collector concerned within three (03) weeks from today, in which event, the same shall be dealt with in accordance with law.

7) With the above direction, the writ petition is disposed of. There shall be no order as to costs.

8) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
