THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.21855 of 2018 ORDER:

Heard learned Counsel for the petitioner and Smt.M.Bhagyasree, learned Standing Counsel for the respondentCorporation. The alleged inaction on the part of the 2nd respondentMunicipal Corporation in taking action on the building construction permission application, dated 25.04.2018, said to have been made by the petitioner herein is under challenge in the present Writ Petition.

According to the petitioner, he is the absolute owner and possessor of the land in Sy.No.596 admeasuring 212 Sq.Yds., bearing premises No.21-2-171//27 of Markandeya Colony of Janagaon Shivar of Ramagundam Mandal of Peddapalli District, having purchased the same by way of a registered sale deed bearing document No.2145/2016, dated 19.08.2016. According to the petitioner, though he submitted an application for building permission, as long back as on 25.04.2018, the respondentMunicipal Corporation authorities are not taking any action on the said application.

When the matter is taken up, it is submitted by the learned Standing Counsel for respondent No.2-Municipal Corporation that earlier the unofficial respondent herein-R.3 filed W.P.No.12054 of 2017 and this Court on 30.04.2018 passed an interim Order directing removal of the structures unauthorizedly constructed by the petitioner herein. It is further submitted by the learned

Standing Counsel that pursuant to the said Order, the Municipal Corporation removed the structures raised by the petitioner herein. Since it is the only grievance of the petitioner herein that the respondent-Corporation authorities are not considering the building permission application, this Court, in the facts and circumstances of the case, deems it appropriate to dispose of the Writ Petition, with a direction to the 2nd respondent-Corporation to consider the building permission application of the petitioner herein, dated 25.04.2018, and take appropriate action strictly, in accordance with law, as expeditiously as possible. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
